говорить всегда хочется о чем-то интересном, рассказать что-нибудь за книжку или про кино, о том, что Блэйк иллюстрировал Данте, или как сам вчера застрял в случайно раскрытом новом пабе до полуночи, играя в забытые слова; о том, что видел у друзей на выставке, или про две картины, что купил в галлерее за углом; о планах на поездки, соплях погоды или утраченных библиотеках.

но получается все равно одно дерьмо, жизнь слишком полна цитатами из второсортных романов:

People who are repressed and unable to experience their full value as a human being, whether they are a citizen of some country or not.

All of the issues to Statelessness simply vanish when a government respects all the people within its realm.

A series of slips by the nation’s top cop followed by communications minister Malcolm Turnbull has made Australia’s data retention bill even more of a potential horror than it seemed when it was introduced last week.

It started with the Australian Federal Police commissioner Andrew Colvin saying that stored telecommunications metadata could be used to go after people who infringe copyright online. That statement, made on October 30, was unequivocal – he used the word “absolutely”.

[Т]he Australian state of Victoria passed a controversial law giving police wide-reaching powers over protesters.

Police can now move on, fine or arrest people they believe are ‘causing or likely to cause’ obstructed access to buildings or impeding the movement of people or traffic, or people they anticipate may become violent. Additionally, courts can issue exclusion orders (bans on being in a designated public space for up to 12 months). Breaching a penalty order can result in two years’ imprisonment.

каторжане с другого конца света не отстают, но там все уже давно настолько маразматично (oh, yeah), что кого этим удивишь?

The Coalition Government has introduced legislation governing the mandatory retention of telco metadata [emphasis mine] into Parliament – a bill that does not provide any explanation of what data is to be stored.

The bill prescribes that telecommunications service providers must retain a yet-to-be-detailed dataset on each customer for two years, to be made available to law enforcement agencies without a warrant.

оставив чудесное “without a warrant” в стороне, мне вот интересно, что вообще такое metadata в данном контексте? скажем, DHCP-логи — это примерно гигабайты в сутки. а это ведь только IP-адреса клиентов. что дальше, DNS? и вишенкой на торте пара чудесных веснушчатых ребятишек с ping-ботами в сети?[1]

плюс, ведь это еще надо как-то обрабатывать и предоставлять требуемую информацию соответсвующим агентствам если не моментально, то очень, очень быстро, да? расходы на поддержание такой инфраструктуры сделают работу провайдера элементарно невыгодной (если не невозможной). так что неудивительно, что они идут в суд — к счастью для нас.

есть здесь какая-то удивительная монархическая ирония, да?

It took Sweden six years to begin compliance with the Brussels-issued Data Retention Directive, so it is not entirely clear why the country is matched only by the UK in its determination to keep storing local customer information.

кто бы мог подумать, что одну из наиболее характерных цитат, ключом размыкающую столь многое в нашей истории, я встречу в жалком детективном романе:

надо ли говорить, что именно так вырос Парламент, отсюда проистекают золотые реки free trade, на сих словах зиждется то, что упреждало Солнце от заката, если верить забытому Джорджу Макартни[1] — да, действительно, сложно не поддаться очарованию англо-саксонского права, задыхаясь в обычном римско-германском.

on a personal note, могу так же добавить, что именно так, we play by our own rules, должно строить и сами жизни: опрессионнные режимы наших государств еще успеют напугать или приструнить нас, своих граждан, однако если уж выбирать во что верить, то одна лишь свобода того достойна.

кстати, а почему многих так удивляет название “антитеррорестическая операция” по отношению к действиям вооруженных сил Украины, проводимым сейчас на востоке страны?

потому что, come on, достаточно посмотреть определение терроризма, да? заглянуть в любой соответсвующий документ или закон? если сами не способны придумать, то может хоть чужие прочитать? вот, скажем, в кодексе Соединненных Штатов Америки (“involve violent acts or acts dangerous to human life that are a violation of the criminal laws”). или, например, The Terrorism Act 2000, принятый Парламентом Великобритании:

  1. In this Act “terrorism” means the use or threat of action where—
    1. the action falls within subsection (2),
    2. the use or threat is designed to influence the government or an international governmental organisation or to intimidate the public or a section of the public, and
    3. the use or threat is made for the purpose of advancing a political, religious, racial or ideological cause.
  2. Action falls within this subsection if it—
    1. involves serious violence against a person,
    2. involves serious damage to property,
    3. endangers a person’s life, other than that of the person committing the action,
    4. creates a serious risk to the health or safety of the public or a section of the public, or
    5. is designed seriously to interfere with or seriously to disrupt an electronic system.
  3. The use or threat of action falling within subsection (2) which involves the use of firearms or explosives is terrorism whether or not subsection (1)(b) is satisfied.

по-моему, то есть, совершенно очевидно, что деятельность сепаратистов — это самый натуральный терроризм, не меньше, и мне совершенно непонятно, что еще тут можно обсуждать.

с другой стороны, with a tin foil hat on, давайте задумаемся еще вот о чем: суверинетет Парламента — это основополагающий принцип некодифицированной Конституции Великобритании. однако, подписав акт 1972 года о вступлении в Европейский союз, Парламент Великобритании тем самым добровольно[1] ограничил собственные полномочия и обозначил господство права Еврпоейского Союза.

иными словами, поскольку существует ненулевая вероятность, что этот процесс Велибритания проиграет — или любой аналогичный в будущем — то не с этим ли связана очередная волна настроений и размышлений о возможном выходе Великобритании из ЕС? ингсоц-то, очевидно, куда проще строить на пару с NSA — а не с ECJ.

    Some public comments on the decision of the Court of Justice, affirming the jurisdic‚tion of the courts of member states to override national legislation if necessary to enable interim relief to be granted in protection of rights under Community law, have suggested that this was a novel and dangerous invasion by a Community institution of the sovereignty of the United Kingdom Parliament. But such comments are based upon a misconception. If the supremacy within the European Community of Community law over the national law of member states was not always inherent in the EEC Treaty it was certainly well established in the jurisprudence of the Court of Justice long before the United Kingdom joined the Community. Thus, whatever limitation of its sovereignty Parliament accepted when it enacted the European Communities Act 1972 was entirely voluntary.

    Under the terms of the 1972 Act it has always been clear that it was the duty of a United Kingdom court, when delivering final judgment, to override any rule of national law found to be in conflict with any directly enforceable rule of Community law. Similarly, when decisions of the Court of Justice have exposed areas of United Kingdom statute law which failed to implement Council directives, Parliament has always loyally accepted the obligation to make appropriate and prompt amendments. Thus there is nothing in any way novel in according supremacy to rules of Community law in those areas to which they apply and to insist that, in the protection of rights under Community law, national courts must not be inhibited by rules of national law from granting interim relief in appropriate cases is no more than a logical recognition of that supremacy.

вообще, говоря о тенденциях, впору задуматься над тем, что есть доверие к власти, и каковы его пределы? как сказал на прошлой неделе Том Уотсон, “forcing through the surveillance laws is a further erosion of political trust”, и вот хорошая цитата по этому поводу:

Lord Hope of Craighead in R (Jackson) v Attorney General case: It must never be forgotten that this rule, which is underpinned by what others have referred to as political reality, depends upon the legislature maintaining the trust of the electorate. In a democracy the need of the elected members to maintain this trust is a vitally important safeguard. The principle of parliamentary sovereignty which in the absence of higher authority, has been created by the common law is built upon the assumption that Parliament represents the people whom it exists to serve.
